TheYukon.ca - Terms of Use Agreement

Introduction
Welcome to TheYukon.ca. This site was created by and is maintained by the Council of Yukon First Nations, hereinafter referred to as CYFN. TheYukon.ca was created to enhance the economic and social well-being of Yukon citizens. Building a Yukon Internet presence and sustaining an on-line registry for Yukon business, governance and community organizations is expected to stimulate commercial activity and economic growth in Yukon communities. Please be aware that some products and services offered through this site may only be available in specific geographic regions. Some services may also have specific rules and guidelines or associated fees.
This page may be updated at any time without notification. You have a responsibility to review this page and you are accepting these Terms of Use by using this site and/or its services. Any personal information that you choose to disclose via modules on this website or any linked websites is done at your own risk..
Site Services
This community Portal is an online information and communication service provided by CYFN. The following levels of service are available through TheYukon.ca:
Free Services
• This site is available for use by the general public at no charge.
• A directory listing page is available for free to Yukon business, governance and community organizations. Users are also able to post announcements, events and job listings for free.
• Charity and not-for-profit organizations receive content updates and self publishing privileges at no cost subject to review of usage.
Chargeable Services
• Yukon business and governance organizations requesting directory listing page changes may be charged a nominal fee depending on how often changes are made according to the following fee schedule:
o 5 changes per year – free
o Subsequent changes - $10.00 per change.
• Business and governance organizations with registered membership and self publishing privileges for directory listings will be charged $100.00 per year. Subscribers will be able to post announcements, events, job listings, catalogs, newsletters, photo galleries and promotions.
• A single custom website, integrated with TheYukon.ca, is available to each Yukon First Nations governance organization, for non commercial use, for a fee of $500.00 per year and includes a service guarantee. An organization that is not completely satisfied after the first year will receive a refund and have their website removed.
• Advertising options are available to "for profit" businesses and to other organizations at the discretion of theyukon.ca

Products and services offered through this site may have associated costs and/or fees and as such any contractual agreements or commercial transactions entered into as a result of using this site are strictly between the product/service provider and you the customer. You have a responsibility to choose which organizations you feel comfortable doing business with.
TheYukon.ca retains the right to deny access to anyone at its complete discretion for any reason including for the violation of any of these Terms of Use.
Membership Registration – Information and Privacy
The privacy of your personal information is a paramount concern to TheYukon.ca. All membership registration information and use thereof shall be reasonably safeguarded and the use thereof shall be governed by our Privacy Policy.
Should you enroll as a registered member on this site, you agree to provide accurate current information about yourself and promptly update this information to maintain its accuracy should the information provided change.
Upon registering you will be provided with a login name and password. You are responsible for keeping this information private and confidential. You assume responsibility for the use of services and all activities that occur under your login.
You agree to immediately notify TheYukon.ca should you suspect or become aware of any unauthorized use of services under your login. TheYukon.ca cannot and will not be responsible and liable for any loss or damages resulting from your failure to logout properly.
Should you misrepresent yourself or should TheYukon.ca have reason to believe information you have provided is not true, TheYukon.ca has the right to discontinue your membership and refuse service and future service of the site.
TheYukon.ca is particularly concerned about the safety of children using the site. TheYukon.ca delivers services for a broad audience and as a child's legal guardian it is solely your responsibility to determine if any part of the site is not appropriate for your child to access.
You understand and agree to provide consent that TheYukon.ca may access, archive, and disclose your registration information if required by law or in good faith belief that the disclosure is reasonably necessary to enforce the Terms of Use, to comply with a legal process, or to protect the rights, property, or personal safety of our members, users, third parties and the general public.
User Responsibilities and Privileges
You understand and agree that you are solely responsible for your own content, data, graphics, messages transmitted, or other materials and services used on TheYukon.ca. You are entirely responsible for all information whether publicly posted or privately transmitted using this site and assume all responsibility for any consequences thereof related to your actions using this site.
TheYukon.ca does not control the information posted or transmitted by its users and thus cannot guarantee the quality or accuracy of such information. TheYukon.ca assumes no responsibility nor will it be liable in any way for any information that was posted or transmitted by third parties.
You agree to use this website only to post materials that are legal, proper, somehow related to its purposes, and conform to the decency standard of our community. By way of example, and not as a limitation, you agree that when using this Web Site, you will not:
• Harm children in any way;
• Defame, threaten, abuse or otherwise violate the rights of others;
• Publish any vulgar, hateful, malicious or unlawful material or information;
• Post any material that infringes any patent, trademark, copyright, trade secret, intellectual property or other proprietary right of any party.
• Post any files that contain viruses or corrupted files that may functionally limit the operation of any equipment or may damage another's computer.
• Post or transmit spam, "chain letters", "junk mail", promotional materials or any form of solicitation, advertise or offer to sell any goods or services for any commercial purpose, other than in areas of the Web Site intended for such uses.
• Impersonate another person or entity, or falsify/delete legal documents, proper notices, proprietary designations or source of software.
• Collect or store personal data about other users;
• Encourage, glorify or commit a criminal offense or provide instructional or educational information about illegal activities.
You agree that TheYukon.ca may, given certain circumstances and without prior notification, terminate all membership privileges. Cause for termination shall include, but not be limited to:
• Violations of these Terms of Use and/or the Privacy Policy;
• User initiated request;
• Extended periods of account inactivity;
• Repetitive returned emails from a therefore assumed inactive account;
• Unforeseeable technical difficulties or issues;
• Law enforcement requests
Registered users of TheYukon.ca agree to maintain an active email account to receive administrative messages from TheYukon.ca. All messages will relate to the administration of your account, such as lost password information or account expiration warnings. Further usage of this address by TheYukon.ca will only be with your consent, via mailing opt-ins etc.
Should administrative emails be undeliverable to your email account, TheYukon.ca may, at its discretion, terminate your account.
TheYukon.ca will not be liable in any way for any circumstances that result from the discontinuation of services should your registration account be terminated.

Visitors to any linked site are urged and expected to abide by the Terms of Use and Privacy Policies of that particular linked site.

Intellectual Property Rights
All title and intellectual property rights in TheYukon.ca site are owned by CYFN. All title and intellectual property rights in the information and content that may be accessed through use of TheYukon.ca are the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties (including but not limited to, software, images, photographs, animations, video, audio, music, text and "applets", incorporated into the site, and any copies of software).
This Agreement does not grant you any rights to use such content, nor does it grant any rights to TheYukon.ca other than the right to use the site according to the terms of this Agreement.
TheYukon.ca may, in appropriate circumstances and at its sole discretion, remove or disable access to any material on the site or any subsites that infringes on the rights of others. If you believe that your work has been used on this site in a manner that constitutes copyright or trademark infringement, please provide CYFN with a written notice, by postal mail, e-mail, or facsimile, including the following information:
1. The signature (electronic or physical) of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
2. Identification of the copyrighted work or trademark claimed to have been infringed.
3. A description of or actual page link to where the material in question is located on the Web Site.
4. Your mailing address, telephone number, and email address.
5. A statement by you that you believe in good faith that the disputed use is not authorized by the copyright or trademark owner, its agent, or the law.
6. A statement by you, under penalty of perjury, that the information in your notice is accurate and that you are the copyright or trademark owner or authorized to act on the copyright or trademark owner's behalf.
